Institutional Terms of Service, Benchmark Telemetry & Data Licensing Charter

1.1. Contractual Scope. This legally binding agreement ("Agreement", "Charter") is entered into by and between Airecmark Intelligence AG, a corporation incorporated under the laws of the Swiss Confederation with registered seat in Zürich (CHE-491.204.819, hereinafter "Airecmark"), and any legal person, enterprise entity, researcher, or automated agent system ("User", "Licensee") executing queries against, scraping, embedding, or consuming Airecmark’s benchmark indices, model telemetry data, or scoring interfaces.

1.2. Consent by Telemetry Execution. Under Article 1 et seq. of the Swiss Federal Code of Obligations (Obligationenrecht, SR 220), invoking any HTTP GET/POST endpoint, initializing a gRPC telemetry connection, or rendering Airecmark scoring assets constitutes unconditional acceptance of this Charter. If you act on behalf of a corporate model vendor (e.g., Anthropic, OpenAI, Meta AI, Mistral), you represent and warrant that you hold statutory authority to bind said entity.

2.1. Database & Sui Generis Protection. The compilation of LLM evaluation vectors, deterministic latency traces, context window loss surfaces, and compute cost indices published via Airecmark constitutes protected intellectual creation under the Swiss Federal Act on Copyright and Neighboring Rights (Urheberrechtsgesetz, URG).

2.2. Bifurcated Licensing Architecture:

• Open Research Tier (CC-BY-NC-SA 4.0): Aggregated public benchmark ranks, throughput metrics, and leaderboard snapshots may be cited in academic literature, peer-reviewed preprints, and non-commercial research repositories provided explicit provenance attribution is rendered.
• Proprietary Telemetry & Micro-Traces (Commercial Reserve): Raw Firecracker microVM execution logs, per-token latency percentiles (p50/p90/p99), synthetic stress vectors, and programmatic streaming endpoints are strictly proprietary and require an active Enterprise Evaluation License.

3.1. The Airecmark Citation Mandate. Any model developer, research laboratory, or media outlet citing Airecmark benchmark scores in marketing collateral, investor pitch decks, social media statements, or technical blog posts MUST adhere to deterministic transparency requirements:

4.1. Prohibited Activities. Users and vendors are strictly enjoined from engaging in any behavior calculated to artificially manipulate, pollute, or game Airecmark deterministic testing pipelines:

• Prompt Memorization & Canary Infiltration: Training model weights against Airecmark test datasets identified with cryptographic canary strings (e.g., airecmark-canary-uuid4-2026).
• Model Weight Swapping: Dynamically serving quantized or alternative high-tier weights exclusively when requests originate from known Airecmark test runner ASN IP blocks.
• Distributed Denial & Sybil Voting: Flooding community review clusters or Firecracker microVM testrunners with synthetic telemetry or automated vote farming.

5.1. Statutory Ingress Matrix. Automated scrapers, spiders, and programmatic client libraries must respect the following deterministic access boundaries:

All scrapers must declare an informative User-Agent string containing contact email and entity identity. Anonymous scrapers disguising headers to bypass cloudflare ingress will be summarily blacklisted.

6.1. Neutrality Firewall (Zero Paid Positioning). Airecmark adheres to an immutable engineering firewall: commercial sponsorships, affiliate referral integrations (including PartnerStack links), or enterprise data feed subscriptions SHALL NEVER influence, alter, reweight, or inflate any model’s benchmark score, Elo rating, or comparative ranking position.

6.2. Cryptographic Badge Embeds. White-labeled benchmark badges displayed on third-party documentation pages must utilize Airecmark’s official signed SVG web components with cryptographic hash parameters. Static or unlinked score representations are prohibited without prior written commercial consent.

7.1. "As-Is" Empirical Telemetry. AI benchmark scores reflect point-in-time, deterministic automated executions inside standardized Firecracker microVM isolated runners. Performance characteristics (tokens per second, latency distributions, output hallucinations) can vary based on inference hosting conditions, model weight quantizations, and cloud regional load. Airecmark disclaims all warranties of merchantability, fitness for a particular algorithmic purpose, or continuous operational availability.

7.2. Statutory Cap Under Swiss Law (CO Art. 100). To the fullest extent permitted by mandatory Swiss law, Airecmark’s aggregate financial liability for any claim arising under this Charter shall be strictly capped at the total amount paid by Licensee to Airecmark in the three (3) calendar months preceding the actionable event, or CHF 500, whichever is lesser. In no event shall Airecmark be liable for lost inference profits, indirect damages, or synthetic hallucination liabilities.
